An old man was sentenced to almost five years in jail on two charges of carnal abuse on Friday in the Home Circuit Court in downtown Kingston, thirty years after he sexually attacked a female relative in St. Mary.
The 72-year-old man was found guilty on March 28 at Saint Mary Circuit Court by a seven-member jury. His identity was withheld to preserve the privacy of the complainant, who is now 36 years old.


According to a statement from the Office of the Director of Public Prosecutions (ODPP), the first instance of sexual assault happened in 1993, when the current complainant was just seven years old and the offender was 42.
The second incident of assault happened six years later, according to the ODPP, which labeled the situation a “historical sexual abuse case.”



On Friday, the sentence was forwarded to the Home Circuit Court, where High Court Judge Justice Kissock Laing imposed a four-year, eleven-month sentence on the elderly man for the accusation of carnal abuse found in count one of the indictment.

The individual received a sentence of two years and 11 months of hard labor on count two, under which he was charged with the same offense as stated in the indictment.

Laing stipulated that both sentences should be served consecutively, which would imply that the elderly offender would have to spend a minimum of four years and 11 months in jail.



On count one, testimony was presented at the trial that the complainant visited her grandmother’s home while her mother was at work on an unspecified day between January 1 and December 31, 1993.

The (now) felon walked inside the house and made sexual contact with her at some time after the grandmother left her home alone, according to the ODPP.

The guy intimidated the boy at the time into not reporting the crime.



Prosecutors also presented evidence showing that the complainant and two relatives—both of whom were minors—went to the convict’s residence on a certain day in 1999.

The complainant entered the man’s one-room residence throughout the day and dozed off.

The ODPP claimed that the complainant was awakened from her sleep by the prisoner while they were engaging in sexual activity.

Years after going through her ordeals, the complainant reported to the police in 2013 at the age of 27.



The complainant gave testimony that she learned she could still disclose the crime despite the passage of time since she had previously been advised by her family not to do so, according to the DPP’s office.

When she testified in the trial last month, the lady was 36 years old.
