Following her manslaughter conviction for the deadly stabbing of another woman, a mother of three children is scheduled to receive her punishment at the Home Circuit Court on Thursday afternoon.
Due to a misunderstanding with other attorneys who intend to join the case, Garfesha Smith’s sentencing hearing was postponed from last December to today.
Kadisha Banton’s murder in 2014 resulted in Smith’s conviction. During an altercation with a group of people at her residence on Elm Crescent in Kingston 10, Banton was stabbed.

The police were reportedly called to a major altercation at Elm Crescent where people were attempting to remove Banton from her home because their neighbors said she was a nuisance.

The cops arrived and saw Banton acting boisterously, brandishing a knife, and threatening to douse others with caustic liquid. After Banton started hurling fluids at people in the yard, a fight broke out, and she was stabbed.

Smith was accused of murder, but after a trial in which no less than three witnesses for the prosecution gave inconsistent accounts of where on the property the stabbing occurred, she was found guilty of manslaughter.

Two witnesses who said they observed the murder were likewise unreliable since they insisted that nobody else could have seen the crime. One witness claimed that after Banton was shot to death, someone approached her from behind while she was facing the victim.

One police witness said that Banton was slain with a kitchen knife, however the autopsy report stated that Banton was killed with a ratchet knife. Neither the murder weapon nor any forensic evidence was presented during the trial.
